Regarding Paragraph 1 of Article 9, Regulations for the Deposit of Biological Material for Patent Application, after performing the viability test, the biological material cannot be proven to be viable, including other microorganisms contaminations resulted in biological materials cannot be furnished in the future, (for example: animal cell lines contaminated by mycoplasma). As a consequence, animal cell lines viability tests shall include mycoplasma test. Viability statement shall state “not viable” if mycoplasma test results showed positive for contamination.

Regulations for the Deposit of Biological Material for Patent Application was revised and promulgated on 4th of December, 2012; entered into force on 1st of January, 2013. The key point of this amendment is Article 24 that the certificate of deposit shall be submit the viability test report within the time period set by the Specific Patent Agency. FIRDI will only issue the certificate of deposit after completion of the viability test. For normal cases, it would take in average 10 working days for FIRDI to complete the viability test and issue the certificate of deposit. As for cases that the relevant information of the biological material or its culture medium were needed to be provided by the depositor, the duration of the case may be prolonged. Depositors shall apply as soon as possible to prevent exceeding the statutory time for patent application.
